1.1 This Acceptable Use Policy applies to every customer of the Service and to every User the customer authorises. This Acceptable Use Policy serves as Attachment 3 to the Seed Founding Partner Agreement (South Africa).
1.2 A customer is responsible for the conduct of its Users. Acts and omissions of Users are treated as those of the customer.
1.3 Breach of this policy is a material breach of the customer's agreement with the Provider (the applicable service agreement). Emergency suspensions for severe security or scraping violations take effect immediately.
2. The principle
2.1 The Service is a recruitment CRM. It holds personal information about real people who did not choose the Service and in most cases did not choose the recruiter either. Use it for legitimate recruitment work, hold only data you are entitled to hold, and treat candidate information the way you would want yours treated. Everything below follows from that.
3. Data you may not put into the Service
3.1 You must not upload, store or process:
3.1.1 personal information you have no lawful basis to hold under POPIA, the UK GDPR, the EU GDPR or other applicable law;
3.1.2 personal information obtained by scraping or harvesting in breach of any law, website terms or platform terms, including the terms of professional networks and job boards;
3.1.3 personal information acquired from a third-party list or data broker where you cannot demonstrate a lawful basis and the required notices;
3.1.4 special personal information, meaning information about health, biometrics, religious or philosophical beliefs, race or ethnic origin, trade union membership, political persuasion, sex life or criminal behaviour, unless you have a lawful basis to hold it and it is necessary for the role;
3.1.5 personal information of children, except where you are lawfully recruiting for roles open to them and hold the required parental consent;
3.1.6 payment card numbers, full bank account numbers or identity document numbers, except in the specific fields the Service provides for that purpose;
3.1.7 malicious code, or files you know or suspect to be infected; or
3.1.8 content that is unlawful, defamatory, harassing or infringing.
4. How you may not use the platform
4.1 You must not:
4.1.1 send unsolicited bulk communications, whether from within the Service or using data exported from the Service;
4.1.2 use the Service to contact candidates who have asked you to stop contacting them;
4.1.3 share Seat credentials, or allow more than one individual to use a single Seat;
4.1.5 attempt to access another customer's data, or probe, scan or test the security of the Service without the Provider's prior written consent;
4.1.6 reverse engineer, decompile or attempt to derive the source code, models or matching logic of the Service;
4.1.7 resell, sublicense or provide the Service to third parties as a service bureau, unless expressly agreed in writing;
4.1.8 use the Service, or data from it, to build or assist in building a competing product;
4.1.9 use automated means to extract data from the Service at a scale or rate that degrades performance for other customers;
4.1.10 use automated tools, scripts, or circumvention methods to bypass AI Credit quotas, usage limits, or rate limits established within the Service; or
4.1.11 misrepresent the source of a job advertisement, or advertise a role that does not exist.
5. Automated screening and scoring
5.1 The Service's screening, matching and scoring functionality produces suggestions. It does not make decisions.
5.2 You must not rely on an automated score as the sole basis for rejecting a candidate. A human must review before a candidate is rejected.
5.3 You must not configure or use the functionality to filter candidates on a prohibited ground, including race, gender, pregnancy, marital status, ethnic or social origin, sexual orientation, age, disability, religion, conscience, belief, political opinion, culture, language or birth.
5.4 You are responsible for the fairness and lawfulness of your own hiring process, including compliance with the Employment Equity Act 55 of 1998 where it applies to you.
6. Security expectations
6.1 You must:
6.1.1 keep credentials confidential and not write them down or share them;
6.1.2 enable multi-factor authentication where the Service offers it;
6.1.3 deprovision Users promptly when they leave your business or change role;
6.1.4 notify the Provider at support@seedtalent.co.za without undue delay if you suspect unauthorised access to your account; and
6.1.5 not use a shared or generic email address as a User account.
7. Reporting a concern
7.1 Report suspected abuse of the Service, by anyone, to support@seedtalent.co.za.
7.2 Report a suspected security vulnerability to support@seedtalent.co.za. The Provider will not pursue a good-faith reporter who tests only their own account, does not access another customer's data, does not degrade the Service, and gives the Provider reasonable time to fix the issue before disclosing it.
8. What the Provider will do about a breach
8.1 Where the Provider reasonably believes this policy has been breached, the Provider may:
8.1.1 contact the customer and require the breach to be remedied within a stated period;
8.1.2 remove or disable access to specific content or data;
8.1.3 suspend the affected User, or the account, in whole or in part; or
8.1.4 terminate the agreement in accordance with its terms.
8.2 The Provider will act proportionately, and will give notice before suspending where it is practicable and safe to do so.
8.3 The Provider may suspend without prior notice where the breach presents an immediate risk to the security of the Service, to other customers, or to individuals whose personal information is held in the Service, or where the law requires it.
8.4 The Provider may report unlawful conduct to the relevant authority and will cooperate with a lawful investigation.
9. Changes to this policy
9.1 The Provider may amend this policy. Material changes take effect 30 days after notice by email to customer administrators and by in-app notice.
